A new California law prohibiting schools from mandating parental notification about students’ gender identity changes is facing its first legal challenge. The Chino Valley Unified School District, along with a group of parents, filed a lawsuit on Tuesday against Governor Gavin Newsom and Attorney General Rob Bonta, arguing that the law violates parents’ constitutional rights.
The law, signed by Governor Newsom on Monday, bans school districts from adopting policies that require staff to notify parents if a student requests to use a different name, pronoun, or facilities that don’t match their sex assigned at birth. It’s the first such statewide ban in the nation and comes in response to several California school districts, including Chino Valley, that had implemented parental notification policies.
Emily Rae, an attorney representing the plaintiffs, stated, “School officials do not have the right to keep secrets from parents, but parents do have a constitutional right to know what their minor children are doing at school.”
The lawsuit contends that the new law infringes upon parents’ First and Fourteenth Amendment rights and seeks to have it declared unconstitutional. It argues that the law prevents parents from making informed decisions about their children’s education and well-being.
Governor Newsom’s office defended the law, with spokesperson Izzy Gardon calling the lawsuit “deeply unserious” and asserting that the new law “preserves the child-parent relationship.” Gardon added, “California law ensures minors can’t legally change their name or gender without parental consent, and parents continue to have guaranteed and full access to their student’s educational records consistent with federal law.”
The legal challenge comes amid a broader national debate over LGBTQ+ rights in schools. At least eight other states have laws requiring schools to notify parents about students’ gender identity changes, according to the Movement Advancement Project, an LGBTQ+ think tank.
Supporters of California’s law argue it protects LGBTQ+ students who may face unsafe home environments. Tony Hoang, executive director of Equality California, praised the legislation, saying it “strengthens protections for LGBTQ+ youth against forced outing policies” and “creates critical safeguards to prevent retaliation against teachers and school staff who foster a safe and supportive school environment for all students.”
However, critics, including the California Family Council, contend the law undermines parental rights. Jonathan Keller, the council’s president, stated, “This bill undermines their fundamental role and places boys and girls in potential jeopardy.”
The lawsuit has also drawn attention from high-profile figures. Elon Musk, CEO of Tesla and SpaceX, announced on social media that he would move SpaceX’s headquarters from California to Texas in response to the new law, calling it “the final straw.”
As the legal battle unfolds, it highlights the ongoing tension between protecting LGBTQ+ students’ privacy and safety and respecting parental rights in education. The outcome of this case could have significant implications for similar policies nationwide and the broader debate over gender identity issues in schools.
